by any natural or legal person wishing to make a purchase via the website www.monpetitrouet.com

hereinafter referred to as “the Customer”.

 

1. Object

The present terms and conditions of sale aim at defining the contractual relations between the Seller and the Customer and the conditions applicable to any purchase made through the website www.monpetitrouet.com.
The acquisition of a product through this site implies an unconditional acceptance by the Customer of these conditions of sale which the Customer acknowledges having read prior to his order.
Before any transaction, the Customer declares to have full legal capacity, allowing him to engage under these terms and conditions of sale.

We keep the possibility of modifying these conditions of sale at any time, in order to respect any new regulation or in order to improve the use of its site.
Therefore, the applicable conditions will be those in effect at the date of the order by the Customer.

 

2. Products / Availability

The products offered are those listed on the site www.monpetitrouet.com of within the limits of available stocks.
If there are overlaps between online and offline orders that cause the unavailability of the product that the Customer has ordered, we will contact the Customer as soon as possible. In general, in such cases, we only need a few additional days to deliver the desired product.

We reserve the right to modify the product assortment at any time. Each product is presented on the website with a description of its main features.
The photos are as truthful as possible and do not engage the seller.
We also ask you to note that the displayed colors of the products in our shop may differ from the original colors depending on the setting of your screen.

All the yarns in the shop are hand-spun. No product is the same.
Irregularities such as variations in the thickness of the yarn within the same product or from one skein to another may occur. This peculiarity is due to the manual transformation of fibers into yarn. This is not a defect. We are, of course, trying to keep these irregularities as low as possible.
Minimal irregularities such as variations in the color of the yarn within the same product or from one skein to another may occur due to the natural origin of the fibers. This again is not a defect.

Animals – our wool producers – are brought up to their needs. Therefore, it is possible in some cases that small plant particles are present in the yarn.

 

3. Rates

The prices listed on the product sheets on the website are prices in Euros (€ / EUR), net to pay. VAT is not applicable for self-entrepreneurs, art. 293 B of the CGI (french law). The Seller reserves the right to change prices at any time. However, the price listed in the catalog on the day of the order will be the only applicable to the Customer.
The prices do not include the delivery costs, invoiced in addition to the price of the purchased products.

The shipping costs consist of the postage of the French “La Poste” (depending on the weight of the items) and the packaging costs. The shipping costs are displayed to the buyer as soon as he indicates a country of delivery during the ordering process.

 

4. Order and payment methods

Before any order, the Customer is free to create an account on the site www.monpetitrouet.com. The account creation section is accessible directly from the menu bar. At each visit, the Customer, if he wishes to order or consult his account (order status, profile …), must identify himself using his account-information.

The Customer can order and pay for his products in several stages. The Customer selects the products he wishes to order in the “cart”, modifies if necessary (quantities, references …), chooses the delivery address or registers a new one. Then the shipping costs are calculated and indicated to the Customer.

Then, the Customer chooses the payment method:

– Payment by check
– Payment by bank transfer
– Payment by credt card (secured)

The last step offers him to validate all the information, read and accept the present terms and conditions and the data privacy policy by checking the corresponding boxes. Finally the Customer places his order by clicking on the “order now”- button. This last click forms the final conclusion of the contract – unless he wants to pay by credit card. In this case, it will be forwarded again and concludes the contract after entering the credit card details. Upon validation, the Customer receives a purchase order confirming the registration of his order.
Now the customer is obliged to pay for his order.
Upon receipt of the check / bank transfer / confirmation of payment by credit card, the order will be processed and the Customer will be informed by e-mail.

In order to finalize the payment and trigger the processing of the order, the Customer must print the order form, accompanied by his check payable to Julia Seeker mon petit rouet at the following address: 575 chemin Lajusa, 64390 Burgaronne / France.
No cash payment should be sent. Only checks issued by a French bank, resident in France, will be accepted.

In order to finalize the payment and initiate the processing of the order, the Customer has to make the bank transfer corresponding to the amount of his order to the bank account of Julia Seeker mon petit rouet, whose details are communicated to the Customer.

Finally, the Customer is redirected to the secure STRIPE interface in order to securely inform his personal credit card.  For further information concerning  STRIPE as our payment provider, please take a look at our data privacy policy or www.stripe.com. 

 

5. Transfer of ownership and risks

The transfer of ownership of the Seller’s products, for the benefit of the Customer, will only be realized after full payment of the price by the Customer.
The risk of loss or damage to the products is transferred to the Customer at the moment when he – or a third party he has designated – takes physically possession of the ordered products.

 

6. Right of withdrawal / Return of goods

Under Article L121-20-12 of the [french] Consumer Code, the Customer has a period of fourteen working days from the delivery of the order to exercise his right of withdrawal and thus return the product to the Seller for a refund without penalty. The Customer takes the return shipping costs.
The refund will be made by check or bank transfer.
The purchase price will only be refunded if the returned goods are in perfect condition. This means: Unused, the skein still intact, free from foreign traces such as stains or odors.

 

7. Delivery / Delivery time

Deliveries are made to the address indicated on the order form.
Deliveries are placed by La Poste via COLISSIMO. Delivery times are indicative only; If the delivery time exceeds 30 days after the order, the purchase contract can be terminated and the invoice amount will be refunded to the customer.
We ship the products within three weeks after receipt of payment. The delivery times with La Poste are within France (mainland) 2 to 3 working days, in the EU / Switzerland 4-8 working days.
In the case of shipping to countries outside the EU, your order may incur taxes or additional charges (eg customs duties) which are not paid or invoiced by us, but are paid directly by the Customer to the appropriate customs office or the tax authorities. 9. Liability / Warranty

After receiving the goods, the Customer bears the responsibility for the proper care of the goods. For damages caused by improper treatment, the Seller can not be held responsible.
Care instructions are also listed on the website for each product.

Recommendations for washing wool:
Since wet wool is generally sensitive, the wool should only be washed by hand at a maximum of 30 degrees. Avoid friction between the fibres. If you want to use washing products, please pay attention to their suitability for fine wool.
After washing, carefully squeeze the wool out with your hands and then wrap it in a towel to draw more water out of the fibres. Wool products should always be dried flat, so that they do not lose their shape. Ironing should be avoided.

 

10. Intellectual property (see also: Legal notice)

The owner of the site owns the intellectual property rights on all elements of the site, unless otherwise indicated.
Any reproduction, publication, adaptation and use of the elements of the site (images, texts) is prohibited without the express authorization of the owner of the site (see: Code of Intellectual Property).

 

11. Personal data

The Seller obliges himself to preserve the confidentiality of the information provided by the Customer, which he would have to transmit for the use of certain services. Any information concerning the Customer is subject to the provisions of the [french] law n ° 78-17 of January 6th, 1978.
As such, the visitor / the Customer has a right to access, modify and delete information about him.

12. Applicable law / Dispute resolution

These General Conditions of Sale are subject to French law.
Any dispute arising between the parties, within the framework of this contract, will fall, in the absence of amicable agreement, of the competence of the Commercial Court of the place of domicile of the Seller. French law will be applied.

 

13. Final provisions

If one or more provisions of these terms and conditions were or would become ineffective, this would not affect the validity of the other provisions.
